Exclusive: Automattic CEO Matt Mullenweg on what’s next for Tumblr

It’s been a long and winding road for Tumblr, the blogging site that launched a thousand writing careers. It sold to Yahoo for $1.1 billion in 2013, then withered as Yahoo sold itself to AOL, AOL sold itself to Verizon, and Verizon realized it was a phone company after all. Through all that, the site’s fierce community hung on: it’s still Taylor Swift’s go-to social media platform, and fandoms of all kinds have homes there.

Verizon sold Tumblr for a reported $3 million this week, a far cry from the billion-dollar valuation it once had. But to Verizon’s credit, it chose to sell Tumblr to Automattic, the company behind WordPress, the publishing platform that runs some 34 percent of the world’s websites. Automattic CEO Matt Mullenweg thinks the future of Tumblr is bright. He wants the platform to bring back the best of old-school blogging, reinvented for mobile and connected to Tumblr’s still-vibrant community, and he’s retaining all 200 Tumblr employees to build that future. It’s the most exciting vision for Tumblr in years.

Matt joined Verge reporter Julia Alexander and me on a special Vergecast interview episode to chat about the deal, how it came together, what Automattic’s plans for Tumblr look like, and whether Tumblr might become an open-source project, like WordPress itself. FTC approves record $5B fine for Facebook

At $5 billion, the fine the U.S. Federal Trade Commission is about to levy on Facebook is by far the largest it’s given to a technology company, easily eclipsing the second largest, $22 million for Google in 2012.

The long-expected punishment, which Facebook is well prepared for, is unlikely to make a dent in the social media giant’s deep pockets. But it will also likely saddle the company with additional restrictions and another lengthy stretch of strict scrutiny.

Multiple news reports on Friday said the FTC has voted to fine Facebook for privacy violations and mishandling user data. Most of them cited an unnamed person familiar with the matter.

The case now moves to the Justice Department’s civil division for review. It’s unclear how long the process would take, though it is likely to be approved. A Justice Department spokeswoman declined to comment on the Facebook matter.

For many companies, a $5 billion fine would be crippling. But Facebook is not most companies. It had nearly $56 billion in revenue last year. This year, analysts expect around $69 billion, according to Zacks. As a one-time expense, the company will also be able to exclude the amount from its adjusted earnings results —the profit figure that investors and financial analysts pay attention to.

“This closes a dark chapter and puts it in the rearview mirror with Cambridge Analytica,” said Wedbush analyst Daniel Ives. “Investors still had lingering worries that the fine might not be approved. Now, the Street can breathe a little easier.”

Facebook has earmarked $3 billion for a potential fine and said in April it was anticipating having to pay up to $5 billion.

But while Wall Street — and likely Facebook executives — may be breathing a little easier, the fine alone has not appeased Facebook critics, including privacy advocates and lawmakers.

“The reported $5 billion penalty is barely a tap on the wrist, not even a slap,” said Senator Richard Blumenthal, a Democrat from Connecticut. “Such a financial punishment for a purposeful, blatant illegality is chump change for a company that makes tens of billions of dollars every year.”

He and others questioned whether the FTC will force Facebook to make any meaningful changes to how it handles user data. This might include limits on what information it collects on people and how it targets ads to them. It’s currently unclear what measures the settlement includes beyond the fine.

“Privacy regulation in the U.S. is broken. While large after-the-fact fines matter, what is much more important is strong, clear rules to protect consumers,” said Nuala O’Connor, president and CEO of the Center for Democracy and Technology. The CDT is pushing for federal online privacy legislation.

Some have called on the FTC to hold Facebook CEO Mark Zuckerberg personally liable for the privacy violations in some way, but based on the party line vote breakdown, experts said this is not likely.

Marc Rotenberg, president of the nonprofit online privacy advocacy group Electronic Privacy Information Center, said he was “confused” as to why the Democratic commissioners didn’t support the settlement and said he suspects, without having seen the actual settlement, that this was due to the Zuckerberg liability question.

“But I thought that was misguided,” he said, adding that EPIC instead supports more wholesale limits on how Facebook handles user privacy.

Since the Cambridge Analytica debacle erupted more than a year ago and prompted the FTC investigation, Facebook has vowed to do a better job corralling its users’ data. That scandal revealed that a data mining firm affiliated with President Donald Trump’s 2016 campaign improperly accessed private information from as many as 87 million Facebook users through a quiz app. At issue was whether Facebook violated a 2011 settlement with the FTC over user privacy.

Other leaky controls have also since come to light. Facebook acknowledged giving big tech companies like Amazon and Yahoo extensive access to users’ personal data , in effect exempting them from its usual privacy rules. And it collected call and text logs from phones running Google’s Android system in 2015.

Wall Street appeared unfazed at the prospect of the fine. Facebook’s shares closed at $204.87 on Friday and added 24 cents after hours. The stock is up more than 50 percent since the beginning of the year. In fact, Facebook’s market value has increased by $64 billion since its April earnings report when it announced how much it was expecting to be fined.

Rep. David Cicilline, a Democrat from Rhode Island, said in a statement that the fine gives Facebook “a Christmas present five months early. It’s very disappointing that such an enormously powerful company that engaged in such serious misconduct is getting a slap on the wrist. This fine is a fraction of Facebook’s annual revenue.”

Cicilline leads the House Judiciary subcommittee on antitrust, which is pursuing a bipartisan investigation of the big tech companies’ market dominance.

The fine, however, doesn’t spell the end of Facebook’s troubles. The company faces a slew of other investigations, both in the U.S. and overseas, that could carry their own fines and, more importantly possible limits to its data collection. This includes nearly a dozen by the Irish Data Protection Commissioner, which oversees privacy regulation in the European Union.

Robert S. Mueller III, the special counsel, made his first public comments on Wednesday about the Russia investigation that he took over two years ago.

The following is a transcript of his remarks, as prepared by The New York Times.

ROBERT S. MUELLER III, the special counsel: Good morning, everyone, and thank you for being here. Two years ago, the acting attorney general asked me to serve as special counsel and he created the special counsel’s office. The appointment order directed the office to investigate Russian interference in the 2016 presidential election. This included investigating any links or coordination between the Russian government and individuals associated with the Trump campaign.

Now, I have not spoken publicly during our investigation. I am speaking out today because our investigation is complete. The attorney general has made the report on our investigation largely public. We are formally closing the special counsel’s office, and as well, I’m resigning from the Department of Justice to return to private life. I’ll make a few remarks about the results of our work. But beyond these few remarks, it is important that the office’s written work speak for itself. Let me begin where the appointment order begins, and that is interference in the 2016 presidential election.

As alleged by the grand jury in an indictment, Russian intelligence officers who are part of the Russian military, launched a concerted attack on our political system. The indictment alleges that they used sophisticated cyber techniques to hack into computers and networks used by the Clinton campaign. They stole private information and then released that information through fake online identities and through the organization WikiLeaks.

The releases were designed and timed to interfere with our election and to damage a presidential candidate. And at the same time, as the grand jury alleged in a separate indictment, a private Russian entity engaged in a social media operation, where Russian citizens posed as Americans in order to influence an election. These indictments contain allegations, and we are not commenting on the guilt or the innocence of any specific defendant. Every defendant is presumed innocent unless and until proven guilty.

The indictments allege, and the other activities in our report describe, efforts to interfere in our political system. They needed to be investigated and understood. And that is among the reasons why the Department of Justice established our office. That is also a reason we investigated efforts to obstruct the investigation. The matters we investigated were of paramount importance. It was critical for us to obtain full and accurate information from every person we questioned. When a subject of an investigation obstructs that investigation or lies to investigators, it strikes at the core of their government’s effort to find the truth and hold wrongdoers accountable.

Let me say a word about the report. The report has two parts, addressing the two main issues we were asked to investigate. The first volume of the report details numerous efforts emanating from Russia to influence the election. This volume includes a discussion of the Trump campaign’s response to this activity, as well as our conclusion that there was insufficient evidence to charge a broader conspiracy. And in the second volume, the report describes the results and analysis of our obstruction of justice investigation involving the president.

The order appointing me special counsel authorized us to investigate actions that could obstruct the investigation. We conducted that investigation, and we kept the office of the acting attorney general apprised of the progress of our work. And as set forth in the report, after that investigation, if we had had confidence that the president clearly did not commit a crime, we would have said so. We did not, however, make a determination as to whether the president did commit a crime.

The introduction to the Volume II of our report explains that decision. It explains that under longstanding department policy, a president cannot be charged with a federal crime while he is in office. That is unconstitutional. Even if the charge is kept under seal and hidden from public view, that, too, is prohibited. A special counsel’s office is part of the Department of Justice, and by regulation, it was bound by that department policy. Charging the president with a crime was therefore not an option we could consider. The department’s written opinion explaining the policy makes several important points that further informed our handling of the obstruction investigation. Those points are summarized in our report, and I will describe two of them for you.

First, the opinion explicitly permits the investigation of a sitting president, because it is important to preserve evidence while memories are fresh and documents available. Among other things, that evidence could be used if there were co-conspirators who could be charged now.

And second, the opinion says that the Constitution requires a process other than the criminal justice system to formally accuse a sitting president of wrongdoing. And beyond department policy, we were guided by principles of fairness. It would be unfair to potentially — it would be unfair to potentially accuse somebody of a crime when there can be no court resolution of the actual charge.

So that was Justice Department policy. Those were the principles under which we operated. And from them, we concluded that we would not reach a determination one way or the other about whether the president committed a crime. That is the office’s final position, and we will not comment on any other conclusions or hypotheticals about the president. We conducted an independent criminal investigation and reported the results to the attorney general, as required by department regulations.

The attorney general then concluded that it was appropriate to provide our report to Congress and to the American people. At one point in time, I requested that certain portions of the report be released and the attorney general preferred to make — preferred to make the entire report public all at once and we appreciate that the attorney general made the report largely public. And I certainly do not question the attorney general’s good faith in that decision.

Now, I hope and expect this to be the only time that I will speak to you in this manner. I am making that decision myself. No one has told me whether I can or should testify or speak further about this matter. There has been discussion about an appearance before Congress. Any testimony from this office would not go beyond our report. It contains our findings and analysis and the reasons for the decisions we made. We chose those words carefully, and the work speaks for itself. And the report is my testimony. I would not provide information beyond that which is already public in any appearance before Congress. In addition, access to our underlying work product is being decided in a process that does not involve our office.

So beyond what I’ve said here today and what is contained in our written work, I do not believe it is appropriate for me to speak further about the investigation or to comment on the actions of the Justice Department or Congress. And it’s for that reason I will not be taking questions today, as well.

Now, before I step away, I want to thank the attorneys, the F.B.I. agents, the analysts, the professional staff who helped us conduct this investigation in a fair and independent manner. These individuals who spent nearly two years with the special counsel’s office were of the highest integrity. And I will close by reiterating the central allegation of our indictments, that there were multiple, systematic efforts to interfere in our election. And that allegation deserves the attention of every American. Thank you. Thank you for being here today.

MILLENNIALS CAN’T HANDLE STRESS

They hate being labeled millennial, but think nothing of labeling everybody else.

Being raised by video games that don’t talk back, they’re accustomed to hearing only their voice.

The only friends they ever had were those they could and would annihilate for nothing more than points on a scoreboard.

I’m Sick Of Hearing About Hillary Paralyzed By Defeat

All people need to be represented equally in the political process and given equal access to social services when they qualify.

Laws must apply equally to all people. That includes half the human race – women are the most discriminated against humans on the planet.

It somehow doesn’t look right to blame the woman for the state of affairs of any nation. And then to punish her with loss of benefits because someone didn’t support her freedom to vote for whomever she wanted to vote for? Massive immigration and the cost of free health care, food, housing, clothes, education plus increased funding for those responsible for their care once they cross the border as a result is what drains the budget so that the old white woman who in the 70s fought for all those freedoms for everybody else, gets the shaft.

Yeah, I think that’s ironic. How about fighting for an equal rights amendment for women? Why isn’t there an outrage over women still being forced into subservient roles and jobs? Equal pay for equal work doesn’t exist. But equality doesn’t begin and end there. How about all the women crossing the border? Does anybody really think that they’re going to fight for women’s rights? Not a chance; they’ll set women in this country back instead of move them forward. All they want is the money. They hate Americans and everything else about America. Where’s the money? They essentially get witness protection status upon arriving illegally. Except for the name change, and who really knows about that, since they can’t speak the language, they expect a package – a gift – that includes free rent, food, clothing, healthcare, education, pocket money, job and transportation all for the privilege of gracing this great country with their presence.

There is more to America than Muslims, Mexicans, Gays and Jews. Maybe they should start supporting everybody else, instead of thinking only of themselves. The democrats are taking away that woman’s medicare and social security and giving it via freebies for long periods of time, at least as long as it takes to learn a language in order to get a job and who will baby sit all the born-for-immigration-purposes kids? These people aren’t thinking ahead, only that America will pay for all of it. They have to, otherwise we’ll blow them up and they know it.

The old folks are the ones who always take the hit.

Old woman, yeah.

Senior residences are being filled with young immigrants with or without families from all over the globe, while old white people are getting the boot. I live in one of them, so your words about punishing a white woman who exercised her freedoms, hoping finally somebody would help her, falls on deaf years. The democrats didn’t do it, the republicans won’t do it. I voted for Hillary and all her people do is bitch about their right to be uncivilized.

Hey, I don’t give a damn. Nobody’s fighting for the old white woman – not even Hillary or Obama. The #MeToo movement is not a vote for equal rights for women. It trivializes assaults and rapes against women by focusing on decades-old unwanted kisses and grabs and Hollywood people giving blow jobs in exchange for parts in film. How about focusing on what’s happening now?

Nobody wants to stop human trafficking, because it’s intermingled with massive illegal immigration. That will come back to haunt the democrats. They’re already known as the Party Of Slavery, now they want the Party Of Sex Trafficking added to their prospectus. Plus the right to be uncivilized (from Hillary just this morning). Actually it was “you can’t be civil to…” blah blah anything republican was the target.

Hillary doesn’t know how to be civil and sincere at the same time. That’s her flaw. Those government positions were all given to her. But nobody can work with her. She’s too angry – about everything. She pisses people off. She pissed people off all over the world as Secretary Of State, then wanted their support when she ran for president. They didn’t not want her because she was a woman. They didn’t want her because of her stubborn abrasive style. As it turns out, she exhibited the same traits she hated in her father. “He was gruff”. That’s a nice way of saying ‘mean’. Yeah, well you know what Hillary, if you can’t be civil to your opponents, when working in a public capacity, then you don’t have the right temperament for public office.

I never did like that she threw her father under the bus every time she wanted something. It just didn’t seem right. He was her father after all. Obama did the same thing with his father. Bill Clinton did the same with his.

Didn’t anybody ever teach you coping skills? Why didn’t you learn them on your own?

Oh right, ‘stay mad forever’ is easier than looking at your own responsibility to move forward in a positive not destruction motion.

This constant pity-seeking behavior justifying all the wrong moves made at every juncture is not going to put you back into anybody’s good graces.

You didn’t just lose an election, you fell from grace by your own self-destructive design. I voted for who I thought was a strong progressive woman, who as it turns out was a fake. She was only acting the part. She crumbled like an old stale cookie when she lost. That’s on me. I’m just glad you didn’t win. Anybody who takes this long to get over something isn’t suited for public office.

Stop dragging the entire world through your mud. It’s beginning to sound pathological.

In case you don’t know it yet, nobody wants to see you go through psychological therapy in public. I can see that coming.

By the way, what do Jews and Gays have to do with a white woman’s social security and medicare benefits?

RE: Fixed/Sticky Menus

Fixed/Sticky menus are menus that don’t scroll out of sight when you scroll down your blog or website. They stay fixed at the top of the page, taking space away from your content, but they also are always there on the page, no matter how long you scroll, so that when you want to select a different category, you don’t have to return to the top of the page to do so.

Fixed/Sticky menus are fine for the beginner who only has one line of categories across the Homepage.

For blogs and websites with much larger menus the ‘fixed’ menu gets in the way, taking up way too much of the reader’s view, sometimes as much as half or more of the page.

People want to see more than a few lines of text at a time, even though they read only one line of text at a time. The overall view that the reader experiences is important to their enjoyment of the post they are viewing.

To accommodate both the small sites and the large sites, it would be practical and efficient to give all free and all premium themes the option of a fixed/sticky menu or a menu that scrolls with the page.

Because I have large menus, I can’t use a theme that has a fixed/sticky menu, unless I’m given the option to disengage it.

In addition, content options currently included for some, but not all, themes in the WP Editor, should be available across the board of themes (free and premium) and should be expanded to include the fixed/sticky header option.

Consistency across themes in areas that are important to the experience of the reader is advantageous to Word Press in that more sites can make use of a greater number of themes, whether paid or premium.

How Zuckerberg Destroyed Facebook’s Brand 

The self-inflicted wounds that led to this week’s historic stock sell off

On Thursday, Facebook suffered the biggest stock sell-off in U.S. history, $119 billion in one day — a sign investors no longer have faith in the company’s story or brand.

This sell-off came just a week after CEO Mark Zuckerberg explained to the mediathat he would not take down web sites with information known to be false, including Holocaust denial.

That kind of baffling blunder suggests a corporation and CEO that has lost its way entirely, that simply has no idea what its brand is.

“This is pent-up anger, and the markets exploded at Facebook,” marketing professor Scott Galloway, author of a book on the tech giant, told Yahoo. “It’s deeper than a one-day sell-off. It’s like when your husband screams at you for leaving the garage door open. It’s not about the garage door. It’s about something else.”

  1. Facebook has never had a coherent brand story.
  2. Facebook isn’t in sync with its customers on the core value of privacy.
  3. Zuckerberg turned Facebook into the world’s biggest media company, but even to this day he refuses to accept the many responsibilities that role entails.

A MONEY MAKING MESS

These Facebook Ads are a waste of time and money. There’s an option for letting Facebook decide where best to place the Ad – which audience. They sent my last Ad post to countries that don’t speak English. That’s the only language I write in. What a rip off.

Just today they contacted me saying I hadn’t placed an Ad for a while and offered me a 10$ credit if I’d boost a post. I took it, then checked back later and the Ad post (a 5 ingredient fat-free salad dressing) was set up for 40$.

This is fraud. I didn’t sign up for 40$. I just accepted their 10$ credit. I can buy an Ad for 10$. The Ad post was going to run for only one day. If I hadn’t checked back, they would have taken 40$ out of my bank account without me knowing it.

So I had to cancel the Ad. Even that is not an easy thing to do. They set the system up in such a complicated way that it allows them to steal money with impunity. When you’re taking money out of people’s bank accounts, you need to be accessible. Everything is automated, so there’s no one to ask for clarification on anything.

The support system – made up of other Advertisers who can’t figure it out either – is useless. I don’t have a full day to research hundreds of other people’s issues to see if mine falls into the same category as theirs.

The writers who give the Ad instructions purposely leave steps out or hide options in places no one would know to look. I still don’t even know how to get to the Ads Manager from my Facebook page.

The point should be to assist the advertiser, not to derail them.

They could make it simple, but they prefer to keep the advertiser in a state of confusion.

It’s a money making mess. They mess you up while they take your money.

It’s time to overhaul the advertisement instructions. Stop trying to trick people. It isn’t cool.

Speech Freedom Rights Are Doled Out In The USA – you have to wait your turn if you’re white

Donald Trump has mostly silent supporters whose voices are not heard due to the terror tactics being promised against them via the media should they speak out.

It’s past-time for equal PROTECTION under the law regarding freedom of speech rights. The USA is the laughing-stock of the world, demanding freedom of speech rights in everybody else’s country, but then turning a blind eye to the lack of freedom rights in their own.

Stop the insanity of deciding when it’s somebody’s turn.

The Constitution of the USA provides speech protections to all inhabitants all the time, not when the media, the government or special interest groups decide it’s somebody’s turn.

Amendment I

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

A terror situation emerges when public figures or media aka press personalities threaten individuals of the populace for their political views or for how they vote. This needs to be stopped before it gets out of control.

It seems that the only people who have speech freedom rights all the time in the USA is the media aka press. They decide on whose voices get heard. Oh yeah, and Madison Avenue – advertisement agencies decide who has constitutional rights and who doesn’t.

How low can you go?

Humiliation As A Coup Tactic

Non-Russian media writers working for Yahoo are slanting news stories and headlines to influence American politics and its socio-economic landscape by seeking to humiliate democracy, free speech, the military, law enforcement and those who are elected to public office including the executive branches of the USA government.

Humiliation is a common tactic used by the resistance to suppress the current governing system and those who either support it or who as law-abiding citizens survive and thrive independent of political agendas.

Mocking institutions, groups and individuals is the most common form. Spreading embarrassing rumors or making false accusations about one’s character or the character of a group or institution is often done in tandem with the Mocking Assaults.

British Intelligence hires junkies to troll Facebook for the purpose of disrupting the American Street. I just encountered a few. They get edgy when in need of a fix.

I suppose beating people up on Facebook like the bullies they are is better than rolling over a pharmacy.

When they claim you to be off your meds, they’re projecting onto you that they’re in need of theirs.

There were no politicians among the 600 member guest list to witness the legal union of Prince Harry and Megan Markle in Great Britain on 19 may 2018.

Often cited in the American press in the run-up to the event was that President of the United States Donald Trump was purposely left off the guest list.

Well, that was partly correct, but as per usual the press often leaves out the actual facts around a particular headline designed to sell news.

What the American press omitted was that all politicians, elected officials of any sort, were also not invited.

Two high-profile politically motivated Black African figures representing the Nations of Africa did happen to sneak in however, under the guises of billionaire weight watcher, Oprah Winfrey and Chicago preacher, Michael Curry.

A Black Lives Matter Terrorist from Chicago, using biblical quotes and quotes of black civil rights leaders from the past, designed through a royal wedding sermon a call to arms through the power of fire and then a call to sacrifice one’s own blood for the greater good, to heal the past, so the power of love can be found.

Offering one’s life up as sacrifice, to shed one’s own blood and the blood of others for the purpose of liberating those oppressed, didn’t sound much to me like the power of love he kept referencing as his own blood trickled then gushed from a mind of a minister meister gone mad.

That was one speech of a sermon that did not belong at, nor was appropriate for, a wedding of any kind. Politically motivated and racially charged. A sting operation. That the Black Lives Terrorist preacher gone rogue was so unprofessional, acting through his speech pattern like he wasn’t educated, must tell you something about his honesty.

Using biblical quotes to justify the letting of blood – no matter whose blood – is never a good idea nor a compassionate solution to any problem.

All politicians are actors and all actors are politicians. The church was overflowing with them.

This was another instance of Black Lives Matter hijacking a public event – this time a royal wedding.

With more than one billion active users on Facebook worldwide, there is no active head of security or head of an advertising program and no mention of the CIA (Central Intelligence Agency) that conducts social experiments on Facebook.

Search and Seizure – Mark Zuckerberg

Where does the FOURTH AMENDMENT stand on unreasonable search and seizure of a person’s private papers and effects? Where does it state, under what provision, amendment, article or law, that ‘we the people’ have privacy rights? When it’s only the government that can be held accountable for violating our privacy rights, then what’s to prevent large corporations or entities from doing it?

That the Central Intelligence Agency has openly stated that they are a part of Facebook conducting social experiments on Facebook members may qualify Facebook as a government institution. In a letter sent to members stating that nobody complained about their presence as justification for them to conduct said experiments and studies [on unsuspecting members] and to continue doing it, seems to me to misinterpret a lack of complaints as agreement with their policies, procedures and methods… Most people are afraid to challenge anything the CIA does – after all they have a long history of threatening people with torture, money loss, family destruction, career bombs and more for questioning their motives regarding anything they do. Like terrorists they are above the law. Next thing you know, your dog dies. Or you get beaten up by a man on a skateboard waiting for you outside your apartment complex.

Fourth Amendment

FOURTH AMENDMENT: AN OVERVIEW

I. INTERESTS PROTECTED

The Fourth Amendment of the U.S. Constitution provides that “[t]he right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

The ultimate goal of this provision is to protect people’s right to privacy and freedom from unreasonable intrusions by the government.  However, the Fourth Amendment does not guarantee protection from all searches and seizures, but only those done by the government and deemed unreasonable under the law.

To claim violation of Fourth Amendment as the basis for suppressing a relevant evidence, the court had long required that the claimant must prove that he himself was the victim of an invasion of privacy to have a valid standing to claim protection under the Fourth Amendment.  However, the Supreme Court has departed from such requirement,  issue of exclusion is to be determined solely upon a resolution of the substantive question whether the claimant’s Fourth Amendment rights have been violated, which in turn requires that the claimant demonstrates a justifiable expectation of privacy, which was arbitrarily violated by the government.

In general, most warrantless searches of private premises are prohibited under the Fourth Amendment, unless specific exception applies. For instance, a warrantless search may be lawful, if an officer has asked and is given consent to search; if the search is incident to a lawful arrest; if there is probable cause to search and there is exigent circumstance calling for the warrantless search.  Exigent circumstances exist in situations where a situation where people are in imminent danger, where evidence faces imminent destruction, or prior to a suspect‘s imminent escape.

On the other hand, warrantless search and seizure of properties are not illegal, if the objects being searched are in plain view. Further, warrantless seizure of abandoned property, or of properties on an open field do not violate Fourth Amendment, because it is considered that having expectation of privacy right to an abandoned property or to properties on an open field is not reasonable.

However, in some states, there are some exception to this limitation, where some state authorities have granted protection to open fields.  States can always establish higher standards for searches and seizures protection than what is required by the Fourth Amendment, but states cannot allow conducts that violate the Fourth Amendment.

Where there was a violation of one’s fourth amendment rights by federal officials, A bivens action can be filed against federal law enforcement officials for damages, resulting from an unlawful search and seizure.  Under the Bivens action, the claimant needs to prove that there has been a constitutional violation of the fourth amendment rights by federal officials acting under the color of law.

However, the protection under the Fourth Amendment can be waived if one voluntarily consents to or does not object to evidence collected during a warrantless search or seizure

…To the very members of congress who will be asking him questions regarding the illegal and immoral sharing of personal data of Facebook members.

The members of congress even told him what to say when he testifies.

I’m assuming here that many members of congress and their rich friends own stock in Facebook, thus should be recused from participating in and/or acting on behalf of their stockholders by watering down the gravity of Mark Zuckerberg’s offenses against members of Facebook who are led to believe that they have security and privacy, when they don’t.

Facebook sold that information. They made huge profits off of perversely peeping into the private messages of Facebook members. Mark Zuckerberg even knows which members he peeped on according to the nightly news reporting that Facebook would be notifying many millions of account holders that their private messages were compromised.

Intentionally compromised.

For Profit.

Tampering with the USA mail is a crime – a federal crime.

People don’t much send letters anymore. They rely on private services to communicate quicker and they are encouraged to do that.

We’re not talking hackers here.

We’re talking about the founder, CEO and Chairperson of Facebook himself who made these [what I call] criminal and immoral decisions for profit.

Full disclosure and transparency will never happen with Facebook as long as the CIA (Central Intelligence Agency) is working the bowels of that ship.

Testifying before congress is a sham. Facebook’s stock tanked and the stockholders are going crazy losing all that money, so they want Zuckerberg to ease their money worries by apologizing to the victims of his peeping for profit scam.

Am I the only one who sees the corruption here? Zuckerberg acts like his form of corruption is necessary so poor people around the globe can gain access to his corrupt mail service.

Are you kidding? No one in impoverished nations is going to want to gain access to Facebook knowing they’ll be spied on and their personal data sold to the highest bidder as a common course of operating procedure.

All they’re going to do is try to sell you merchandise and services that you can’t afford anyway. But in addition, they’ll sell your privacy to anybody who has an interest in you.

Bad people…

…who will ruin your life if they choose, or hold over you for their own profit embarrassing stuff that no one has a right to know.

Before long people won’t feel at ease talking about personal issues in the privacy of their own homes.

Mark Zuckerberg over-bloats the importance of Facebook. He after all designed it by humiliating people. He’s a sociopath put in charge of your private messages and gloats about stealing and selling your private thoughts as a necessity.

He even now, while he’s supposedly under investigation, has gone so far up the pole that he wants you to start paying him for your privacy. Facebook just lost round about sixty-seven billion dollars in its stock value – a company that has essentially no overhead. How did they get that wealthy? He doesn’t manufacture a product. It’s all fluff. You can’t even contact Facebook when you have a complaint. Everything is done by automation.

What does his employees actually do, except spy on it’s members?

Now he wants you to pay him not to spy.

Just put your ads on Facebook. You don’t need to know what someone is saying to their friend. What, you think people private message about products for sale? They private message about private stuff. Private messages do not reflect nor predict buying habits. Stop with the lying and the insanity.

Zuckerberg’s net worth is 63.9 billion dollars. Again, what does he produce? What does he sell? How do you ship his product? What’s his overhead?

Facebook is one of the biggest scams of all time.

People lie on Facebook. They embellish just about everything – or just plain make stuff up. But somehow Mark Zuckerberg has convinced the advertising industry that they can take to the bank anything any Facebook member writes on Facebook – especially the private stuff…

…And he thinks it’s legal to tamper with people’s mail.

Peep for profit is evidently legal in the USA and congress evidently supports his actions – since they are treating him in a way that no other person being called to testify before congress would be treated, by allowing him free access to those individuals who will be questioning him before he’s questioned. The citizens of the world should have access to those conversations.

Did he submit a notarized copy to congress?

In an opening statement each lawyer representing each client talks to the jury before witnesses actually take the stand. They are not held to the truth in any manner. They are allowed to omit, embellish, prejudice the jury members, say anything they want to say – and do.

So in absence of a trial, Mark Zuckerberg’s lawyers decided on a trial by public opinion, purposely designing it that way. They also, knowing they had the attention of the world, decided to tell the world of their plan to charge Facebook members for privacy. I guess now they’ll only sell private information of those who can’t afford to pay. So why again, does Madison Avenue want to sell products to those they know can’t afford to buy their product?

It’s a scam. Wake up FBI. WHAT ARE YOU DOING?

It’s all a game using people’s intellectual material as their own – to sell to other people who want it, who then pay for it. Anonymously of course. Except you. You’re not anonymous. And why should their ads pop up in your message box, which is the same as a mail box?

THEY SHOULD BE PAYING YOU.

Stealing your intellectual material is copyright infringement. Whatever you write is protected by law.

Nobody has a right to look at it unless you give them that right. Nobody has a right to steal your intellectual material. Nobody has a right to sell your intellectual material. Nobody has a right to pay for somebody else’s intellectual material that isn’t their’s to sell.

How can you believe that it’s only for advertising purposes, when the people doing it lied about everything else? They knew they were doing something illegal, that’s why they kept their actions private. It didn’t work though did it?

The world does not need Facebook. It’s filled with lies. Nothing gets looked at, liked or shared unless it’s outrageous, or manipulated. People have to invent, create outrageous. The CIA creates too many posts as social experiments at the expense of leaving real people’s posts out of your news feed. It’s basically government and Madison Avenue trying to amuse you or abuse you into toeing their lines or destroying individuals they don’t like.

Any time I want to learn about a product I see on television or elsewhere, I never go to the corresponding Facebook page. I go directly to their website. Facebook pages tell you very little about a product. They’re too manipulated by Facebook.

One must wonder about all those Facebook suicides and what roles the CIA played in creating the on-line environment that resulted in those tragic deaths.

FACEBOOK IS A SEWER that needs to be eliminated. It grew into a monster because it was created and designed by a monster.

Mark Zuckerberg should not be getting special privileges from congress.

Why all the privacy around a meeting with those who will be questioning and judging him?

Because the government is involved. Any time the government is involved, the government protects the government.

Why isn’t the USA government raiding the offices of Facebook and Zuckerberg and everybody else involved? Seems like they’re giving them time to hide their self-incriminating evidence.

How rigged is that?

Websites are free these days. Easier to use, fewer restrictions. More space to be creative. Fewer complications. Facebook Pages are dinosaurs that have become extinct. Facebook forced me to create a page even though I didn’t have a business. They locked me out of my account until I created one. There was no one I could complain to. Then they want to charge me 5$ for each post so more people would see it.

At 5$ a post x 7 websites (1 post per day) x 365 days in a year = 12,775$.

I tried it once. Out of over 3000 people who liked my page, it only reached something like 35 people. Most of my posts reach around 5-10 people. These posts don’t fly by themselves. They’re placed.

Who can afford it? Evidently big businesses. But does it work? Just because it lands in somebody’s feed doesn’t mean they’ll see it. They might scroll right by it. So then Facebook manipulates the scroll, to make you look.

Nobody likes being manipulated. They went too far too long and now they’re gone. It’s a waste of precious time for the sole purpose of making some sociopath so rich he thinks he controls the planet.

Looking out at her quaint Alabama backyard in late January, Charlie Stephenson noticed something unusual. A strange species of unfamiliar yellow bird was pecking at her hanging birdfeeder.

As a seasoned birdwatcher, Stephenson had seen scores of cardinals in the past. But with its mustard-color coat, this flier was different. So, she took a photo with her iPhone and posted it on Facebook.

Stephenson told AL.com she has seen albino and leucistic birds, the latter being animals that are mostly white but can produce some pigment. But this golden visitor is neither: it’s a male northern cardinal with a “one in a million” genetic mutation that made its red feathers yellow, according to Geoffrey Hill, a bird curator at Auburn University in Alabama.

In his 40 years of cardinal birdwatching, Hill has never seen a yellow bird like this in the wild. The unusually yellow cardinal is not to be confused with the yellow cardinal, an endangered South American species with black and white markings and the occasional green tinge…

Outdated Listening Devices Kill People – updated

It wasn’t Cuba as everybody claimed when American embassy personnel got sick from sounds, and exhibited neurological symptoms as a result.

Just as it wasn’t Cuba in my own Villa Saint Rose Of Lima building where I live in Cleveland, Ohio [on the edge they call it] where CIA reigns supreme, conducting along with FBI and NSA and Mossad and Maxine Waters, social experiments via HUD.

The pain in my ears was so severe, so intense, for weeks. Late day till morning when it was gone, day after day, night after night. Sore throat on sides deep down into neck under ears. Eustachian tubes – the remembering of the terminology made me recall I was a nurse once. Then I remembered the doctor who took my gallbladder out who said to me, “once a nurse always a nurse”. Never go away pain except for periods of time during a 24 hour period – while sleeping.  Could hardly move my body, I mean my entire body could hardly move, the more late in the day/night it became.

I’m being paralyzed is all I thought. But by what? I’m still thinking, I’m being paralyzed. But by what?

I fall in bathroom when I get up to pee in the night, get a concussion, terrible fall, like nothing ever I experienced, can’t walk straight anymore, going off-balance all the time – dizzy, just like those ambassadors. I’m dying.

And nobody sees it. Nobody knows it. I can hardly hear anything. That’s what they wanted. All those perverted government people who like to destroy people because they were hired to do it. That’s my job they always say.

Blame it all on Cuba, when really it was the USA experimenting on their own. Making Cuba responsible, so the USA can extort them again – really? – again?

And if it was of course, as always, Russia’s fault, then it must be of course President Trump’s fault.

Does anybody even know that I am as much Russia as I am Lithuania? Just an aside here in a Scottish war: What, a Scot can’t be a Russian? Come on.

It wasn’t Cuba – unless Cuba is in my building using those same flawed, outdated devices – and if they are, then why?.

I’m thinking about a Russian down the hall. Maybe she really isn’t Russian. Who cares? I don’t.

No. It’s upstairs or downstairs – not sideways – not lateral; this is how these devices work – in past. Up or down.

Sonic devices. Sonic torture. Of course I’m all over it. Are you kidding me? You can’t fucking stop a hurricane?

I don’t know the device. I can’t see it. My brain knows it. My soul will find it and when that happens, then God damn those who tried to kill me by sound.

I know the torture. I am experiencing that torture now.

Stop.

Ten months later: It’s the multitude of cell towers on the top of our building causing the noises and symptoms. What are all those wires doing in the trash room on the 7th floor where I live? Wrapped around pipes? Somebody installed some new devices on the roof. It’s like a city up there. City of Death.

There are huge health problems associated with those cell towers, aside from the cancer risk. Though lots of people get cancer in this building – too many. Lots of people die unexpectedly – too many.

Ever notice how the cell towers go up on government-funded buildings? And it’s never just one. It’s how many can we fit with no regard for the safety and well-being of the tenants? Seniors, handicapped, low income, no job people, immigrants, street people, who cares? They don’t. The government and the owners of the buildings who allow it without permission from those exposed to the hazards, think we all don’t have brains and are near death anyway. Well, they’re right about one part of the that, we’re sitting right beneath and many times beside death – so yeah we’re near death. Tenants for years have been reporting ghosts in the building. Maybe they’re onto something.

The roof could collapse from the weight of all of them. And many swing down over the sides of the buildings next to people’s windows. The cell towers, not the ghosts. But who knows about the ghosts except those who claim they’re here.

Those buildings where they accept government waivers and vouchers and section 8 to lower the rent for vulnerable people, and accept loans from HUD (Department of Housing and Urban Development) are the recipients of these towers. Of course the government or whoever is responsible for placing cell towers where they do, give the owners a financial incentive. Renters don’t have a say, because they’re never briefed on the hazards.

Owners of buildings who don’t accept government subsidies don’t have the towers. Mine’s two blocks from Lake Erie, so of course there’s a lot of spying going on in a multi cultural neighborhood with lots of immigrants, lots of drug and human trafficking, lots of high level government and low level government employees plus the shoreline that I’m assuming must be protected from Canadian Invasions. Of course once it’s out that terrorists are coming in from the south, they’ll change plans and come from the North via Canada from whatever Middle Eastern country wants to harm us.

Justin Trudeau, prime minister of Canada is too immature to run a country if he doesn’t understand the need for security at all USA borders. Canada is ripe for terrorist passageway into the USA. Trudeau gives comfort to the enemy by mocking our president’s concern for security, as if it’s all a big insult to Canadians. If Canada is our friend, then they will increase security at their own borders to keep terrorists from entering the USA.

When I look out over the landscape toward the lake, there are cell towers everywhere – not only disorienting people, but disrupting electronics too. In this building the electrical garage door is always on the fritz. The main door that has a swipe keypass, same thing. The elevator, same thing. The repair people can’t any of them to stay in good working order. What’s with that?

Whatever programs the synchronizing of traffic lights often gets interrupted at main intersections. They go haywire, putting everybody at those intersections at risk for bodily harm from traffic accidents. Entire blocks lose access to power. Sometimes just individual stores. Except for a small segment of Gold Coast inhabitants who are rich, most of the area is mostly poor, which means most of the area is being exposed to high levels of dangerous frequencies that harm the nervous system, because they’re are so many cell towers everywhere poor people rent apartments. They’re not curing anything, that’s for sure.

WiFi (wireless networking technology) is the next big causal link to neurological diseases and disorders. It uses radio waves (radio frequency technology) emitted from cell towers to wirelessly connect the world via internet devices. I don’t have to predict it, I’m experiencing it.

AT&T is in our building. So is Spectrum Cable aka Time Warner. That means the NSA (National Security Agency) is using this location as a spy depot. Internet issues run rampant in this building. Cable T.V., same thing. Different species but still the ‘same animal’ type scenario. With the AT&T and Spectrum merger everybody gets the spy treatment on all of their devices plus the most vulnerable in society foot the bill for everybody else in the high risk to health environment where the cell towers live.

They’re monsters.
